By accessing or using Mondrix.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you ("User", "you", "your") and Mondrix.ai ("Company", "we", "us", "our").

Mondrix.ai is an AI-powered website creation platform that generates professional websites based on user-provided information. The Service includes:
You must be at least 16 years of age (or the age of majority in your jurisdiction) to use the Service. By using Mondrix.ai, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

Our current plans and pricing are displayed on our Pricing page. Prices are listed in US Dollars (USD) and are subject to change with 30 days' prior notice.
Website creation fees are one-time charges. Payment is required upon submission of your website request. All fees are non-refundable except as expressly stated in Section 5.4.
Hosting and domain services (where applicable) are billed annually. The annual fee is stated on the pricing page for each applicable plan. Renewal fees will be charged automatically unless you cancel at least 14 days before the renewal date.
If you are not satisfied with the initial AI-generated website, you may request a revision within 7 days of delivery. If, after one revision, the result does not meet your reasonable expectations, you may request a full refund of the website creation fee within 14 days of the original delivery. Refunds for hosting and domain fees are not available after the domain has been registered.
We accept major credit/debit cards and other payment methods as displayed during checkout. All payments are processed through secure, PCI-compliant third-party payment providers.
You retain ownership of all content, text, images, and data you provide to us ("User Content"). By submitting User Content, you grant Mondrix.ai a worldwide, non-exclusive, royalty-free license to use, process, and display your content solely for the purpose of providing the Service.

The Service uses artificial intelligence to generate website designs, text, images, and other content. You acknowledge and agree that:
The Mondrix.ai platform, technology, branding, design system, algorithms, APIs, and underlying code are the exclusive property of Mondrix.ai and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand assets.
Subject to full payment and compliance with these Terms, you own the content of the website generated for you. However, the underlying templates, code frameworks, and design systems used to generate your website remain the property of Mondrix.ai.
If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without restriction or compensation.
You agree not to use the Service to:
We reserve the right to suspend or terminate your account and remove any content that violates this policy, without prior notice or refund.
For plans that include hosting, we provide managed hosting on our infrastructure. We strive to maintain 99.9% uptime but do not guarantee uninterrupted availability (see Section 11).
Certain plans include a custom domain name registration. Domain names are registered through third-party registrars on your behalf. Domain availability is not guaranteed and is subject to the registrar's terms. You are the registrant of any domain we register for you.
The Simple Landing Page plan includes a free subdomain on our platform (e.g., yourname.mondrix.ai). We reserve the right to reclaim inactive subdomains after 12 months of inactivity.
We aim to provide a reliable and performant Service. However, the Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
Planned maintenance windows will be communicated at least 48 hours in advance. We are not liable for any downtime resulting from:
You may terminate your account at any time by contacting us at support@mondrix.ai. Upon termination, your website will be taken offline within 30 days. You may request an export of your website data before termination.
We may suspend or terminate your account immediately, without prior notice, if:
Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination, after which it will be permanently deleted. Sections 6, 7, 8, 13, 14, 15, and 16 survive termination.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless Mondrix.ai and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. For users in the European Union, mandatory consumer protection laws of your country of residence shall apply where applicable.
Any dispute arising from or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
If you are a consumer in the European Union, you may also submit disputes to the Online Dispute Resolution (ODR) platform of the European Commission at ec.europa.eu/consumers/odr. Nothing in these Terms shall deprive you of mandatory consumer protection rights under EU law.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND MONDRIX.AI AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email and/or by posting a prominent notice on the Service at least 30 days prior to the changes taking effect. Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the updated Terms.
If you do not agree with the modified Terms, you must stop using the Service and may request account termination.
